Foundry Pre-Launch Terms

These terms cover Foundry's public description, readiness scan, waitlist, and walkthrough requests. A pilot, software delivery, guided service, support commitment, or payment requires a separate signed agreement.

1. Scope and relationship to other terms

These terms supplement the Artifocial Website Terms for the Foundry page, readiness scan, request forms, and any no-charge product preview or walkthrough we agree to provide. The Website Terms also apply. A later signed software license, services agreement, statement of work, or order form controls if it conflicts with these pre-launch terms.

2. Eligibility and business authority

You must be at least 18. If you act for a company or other organization, you represent that you are authorized to provide its information and discuss its needs. Do not submit customer personal data, confidential production information, credentials, or information you are not authorized to share.

3. Current Foundry model

Foundry is currently described as customer-hosted software plus optional guided services. The customer receives a release artifact and deploys it on infrastructure the customer controls. The customer selects and pays for its own model provider or local model and supplies its own credentials. Artifocial does not currently promise cloud hosting, managed operations, or resold model inference.

Product descriptions, demonstrations, release notes, and roadmap statements are informational and may change before a signed order. A request does not guarantee acceptance, a delivery date, a particular feature, support level, or price.

4. Readiness scan and walkthroughs

The readiness scan is a self-assessment calculated from your answers and disclosed assumptions. It is not an audit, security assessment, professional opinion, or guarantee of cost savings, readiness, or results. A walkthrough may use sample, demonstration, or pre-release software. You are responsible for independently evaluating whether the information fits your organization.

5. Data and support boundary

The current deployed product sends no automatic product telemetry to Artifocial. Optional support is configuration-only: Artifocial will not access customer production data, customer personal data, production systems, or retain raw diagnostics under this pre-launch scope. Do not provide those materials through a website form or ordinary email. Any exception requires a separate written scope and updated privacy, confidentiality, and security terms before access.

6. Customer-controlled third parties

Model providers, hosting, operating systems, container registries, and other services the customer selects are third-party services governed by their own terms, privacy policies, security controls, and fees. The customer is responsible for its accounts, credentials, configurations, licenses, and lawful use of those services.

7. Acceptable use

You may not use a Foundry preview, artifact, or walkthrough to:

  • violate law, privacy, confidentiality, intellectual-property, or contractual rights;
  • gain unauthorized access to systems, accounts, or data;
  • develop or distribute malware, evade security controls, or facilitate abuse;
  • submit regulated, sensitive, or production data outside an approved written scope; or
  • misrepresent a preview as production-certified, fully managed, or approved by Artifocial for a use we did not review.

8. Ownership and feedback

Artifocial and its licensors retain ownership of Foundry software, documentation, branding, and demonstrations. No software license is granted by a webpage or walkthrough except the limited permission needed to view that material. Any deliverable license, customer-data rights, configuration ownership, output rights, open-source notices, and feedback rights must be stated in the separate agreement that accompanies delivery.

9. Privacy

The Foundry Privacy Notice describes request, scan, and product-boundary information. The Artifocial Privacy Noticedescribes shared website practices.

10. Pre-launch disclaimers and liability

To the maximum extent permitted by applicable law, pre-launch pages, scans, walkthroughs, and preview materials are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, security, or error-free results. Do not rely on a preview for production, safety-critical, legal, financial, employment, or security decisions.

To the maximum extent permitted by applicable law, Artifocial is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or business opportunity arising from the pre-launch surfaces. Nothing excludes liability or rights that cannot legally be excluded. A signed paid agreement must state any negotiated warranties, remedies, liability cap, governing law, and venue.

11. Changes, provider information, and contact

We may change or discontinue pre-launch access and will update the date above when these terms change. These interim terms are provided by Artifocial, the public brand operating the site.
